Raleigh man accused of kicking daughter while tied to baby gate

RALEIGH, N.C. -

An assistant district attorney for Wake County says a Raleigh man kicked his daughter after he tied her to a child's safety gate. The man then fled to Florida with his girlfriend.

Gerald Swinehart, 26, is charged with two counts of intentional child abuse inflicting serious physical injury.

Wake County Assistant District Attorney Jeff Cruden says Swinehart tied his 4-year-old daughter to a child's safety gate with plastic ties and proceeded to kick her. Cruden says the girl's wounds are consistent with the accusations.

Swinehart's girlfriend, 28-year-old Marlaine Coffey, took the child to a hospital and used a fake name to check her in. At which point, prosecutors say Coffey fled to Florida with Swinehart, where they were later apprehended.

Coffey is charged with one count of intentional child abuse inflicting serious physical injury.

Arrest warrants say the abuse occurred earlier this year. The child was taken into the custody of social services March 31.

Coffey is being held under a $50,000 bond. Swinehart is being held under a $100,000 bond.

If Swinehart makes bond, the judge ordered that he wear an ankle bracelet under house arrest.
