Greenville County Man Sentenced For Deadly Sexual Assault

GREENVILLE COUNTY, S.C. -

A Greenville County man was sentenced to 26 years in prison after entering a guilty plea in a deadly sexual assault.

James Byron Rushton, 52, pled guilty to criminal sexual conduct first degree and voluntary manslaughter Tuesday according to the 13th Circuit Solicitor's Office.

Rushton entered the plea in the death of April Smith, 33, on May 29, 2011.

The 13th Circuit Solicitor says Rushton admitted to sexually assaulting the victim multiple times with a potato masher.

Smith wasn't breathing when emergency medical services responded to a 911 call at Rushton's home.

The Greenville County Coroner's Office determined Smith died from an air embolism that reached her lungs during the assault.

Rushton must serves at least 22 years - 85 percent of his sentence - before he is eligible for parole.
