Inmate laid to rest after fatal altercation with Wake County guard

An Apex man was laid to rest today after he died from injuries he sustained during an altercation with a Wake County detention officer.

County officials said Shon Demetrius McClain, 40, of Apex, died Monday from injuries he sustained when Markeith Council struck him on the head on June 4.

McClain had been on life support at WakeMed Hospital since the incident. Council was treated for minor injuries and released.

"Why did it have to happen like this?," asked McClain's friend, Dorothy Easton. "We understand it could've been his time, but it's just the way that it happened that not only his family is bothered by but people who knew Shon are truly bothered by."

The State Bureau of Investigation is investigating whether the detention officer's actions were warranted. The detention officer is on administrative duties pending the outcome of the investigation.

There is surveillance video of the incident, but until the investigation is complete it will remain confidential.

Once the SBI completes its investigation, investigators will turn it over to the district attorney's office, and the da will decide whether Council will be charged with a crime.

McClain was serving time for a misdemeanor charge and failing to appear on drug paraphernalia charges.

According to the North Carolina Department of Public Safety, since the late ‘90s, McClain's convictions include possession of stolen goods, breaking and entering, larceny, indecent liberty with a child, failing to register as a sex offender, and obstructing justice.
