A judge has denied the motion for reconsideration of custody in the case.

The former dog owner, Kerri Blanton says they were told they could go back to magistrate court to file a different form and ask for a jury trial.  They are considering their options.

Blanton and her family originally owned Gracie.  The dog ran away from home and ended up at the Watson's house.

In February a judge ruled that Easley Councilman Dave Watson would get to keep the dog he now calls Gracie.

After the dog lived with the Watson's for five months, the Blantons discovered it was their dog.

The custody battle then went court, where the judge ruled in favor of the Watsons.

The Blantons filed for a reconsideration of the original ruling.

South Carolina does state that if you find a stray dog, it is legally yours after three days.

You must be able to show you made a reasonable effort to find the owner.

For that, you must also inform the court, so they can issue a public notice.

Once that has been done, the original owner has 10 days to claim their pet.
