Solicitor Kevin Brackett completed his review of the investigation into the arrest and death of Mr. Jackie McBeth by the Union Public Safety Department on April 10, 2013.
Brackett says based on the evidence and facts uncovered in this State Law Enforcement Department investigation Solicitor Brackett has concluded that criminal charges against the arresting officer or any party involved are not warranted.
The news release says "McBeth’s unfortunate death was not the result of criminal wrongdoing."
The solicitor says in the report that McBeth was under extreme mental disturbance at the time of the incident and that he was a large and powerful man who had attacked both bystanders and officers and tasers had no effect on him. The report also says that there is no evidence that McBeth's death was the result of any reckless, willful negligence on the part of the officers involved.
The incident happen in April on Highway 176 near Sardis Road in Union.
As officers arrived, they say they came upon an assault in progress. They say the assault was very close to the accident scene.
Police say there was an altercation with an officer trying to intervene in the assault.
