Warrants: Assault on female charge result of throwing urine

Arrest warrants from the case of a prominent criminal defense attorney accused of throwing urine at a police officer give new details into what authorities say happened.

John Montgomery Holmes Jr. was intoxicated at City Limits Saloon in Raleigh Saturday, according court officials. The bar forced him to leave. Authorities said Holmes then exited the cab and attempted to kick in the door of the bar.

Law enforcement serving as security at the bar tried to restrain Holmes, but Holmes kicked the officer. Holmes was arrested, taken to the Wake County Jail and then WakeMed.

Court officials said while at Wake Med, a handcuffed Holmes was escorted to a bathroom by law enforcement and a nurse to obtain a urine sample. Holmes then began to provide a sample to only throw the urine in the face of the officer serving as escort, authorities said.

According to an arrest report, Holmes was charged with assault on a female, assaulting a government official, intoxicated and disruptive behavior, resisting a public officer, second-degree trespass and malicious conduct by a prisoner.

The assault on a female charge relates to Holmes throwing a plastic container with his urine at a WakeMed employee, and the report says the urine "splashed on [her] upper body, arm and neck."

Holmes was released from the Wake County Detention Center on a $30,000 bond.
