    A ruling in New Jersey says you no longer need to be behind the wheel to get busted for texting while driving. A three-judge panel says you could be held responsible if you knowingly text a driver and they crash.

    The appeals court ruling cleared a teenager in related, but says texters have a ‘special responsibility’ for knowingly distracting drivers.  The teen texted a friend moments before he crashed his pickup truck into a couple riding a motorcycle, causing each of them to lose parts of a leg.

    Two members of the three-judge panel says a person sending text messages has a duty not to text someone who is driving if the texter knows, or has a special reason to know, the recipient will view the text while driving.
