Plant City couple blame contractor for pool that popped out of the ground

Posted: Updated:
PLANT CITY, FL (WFLA) -

Fred and Glenda Keely say they paid a contractor $15,000 to upgrade their backyard swimming pool and patio. But they ended up with a pool that popped up out of the ground.

The contractor, Jimmy Carapezza, of True Blue Pools & Spas, says he had no idea he needed a separate pop up insurance policy. He says his insurance company says his policy doesn't cover this and he can't afford to build the couple a new pool. He said the best he can do is cart the pool away and fill in the hole. But he's asked the Keely's to pay for the dirt.

The Keelys say they hired True Blue to replace their patio with pavers, patch a small leak, paint the pool and add this decorative tile. Having no pool, they say, is not acceptable.

"I feel like when you hire a professional to do a job and something occurs like this, then they need to make good on it," Fred Keely said. "Either give us another pool or at least take it out, fix the yard and maybe build a patio or something, and give us our initial money back."

The Keelys say True Blue drained their pool and then the pressure from groundwater caused the pool to pop right out of the ground.

Pools popping up out the ground is a risk when draining a pool in Florida. Experts say that's why contractors need a separate insurance policy specifically for this. They recommend you ask a contractor if they have this kind of policy and ask them to put it in writing.
