ANDERSON COUNTY, SC (WSPA) – The family of a deputy who died during a training exercise has filed a federal lawsuit.

Devin Hodges died on Lake Hartwell in June of last year.

His family is claiming that an Army Corps of Engineers instructor Rick Flemming was negligent and caused Hodges death.

The suit claims that Flemming failed to use the kill switch and a safety lanyard during an emergency stop maneuver.

During that training, Hodges went overboard and was caught in the propeller of the boat.

Flemming was initially charged with reckless homicide, but those charges were later dropped.
